OTHER INFORMATION
YOUTH HANDGUN SAFTEY ACT OF 1998 The Bureau of Alcohol, Tobacco and Firearms (BATF) has produced a YHSA brochure that Licensed Dealers MUST give to every person who purchases a Handgun. Part of the information states It is against the law for a juvenile to have in his possession a handgun or ammunition except for target practice, hunting, or a course of instruction in the safe and lawful use of a handgun unless the juvenile has WRITTEN consent of the juveniles parent or guardian. Parents take note: A knowing violation of the prohibition against selling, delivering, or otherwise transferring a handgun to a person under the age of 18 is, under certain circumstances, punishable by up to 10 years in prison. Parents, if your child has a handgun in their possession without your written consent, then YOU the Parent can go to prison for up to 10 years. GAME WARDENS will be looking for violators.
STRAW PURCHASE The Sale or delivery of a firearm by a licensed Dealer to an Eligible purchaser who is acting as an agent, intermediary or Straw Purchaser for someone who the dealer knows or has reasonable cause to believe is ineligible to purchase directly is a violation of the Federal Firearms Laws. Put another way, If you have taken money from and are filling out the paperwork for another person who, because of age, criminal record, background illness, lives in
another STATE or other conditions could NOT purchase and Fill out the paperwork himself, that would be a STRAW Purchase and Violate Federal Law. DON’T LIE FOR THE OTHER GUY!
FIREARMS AGE You must be at least 18 years of age to purchase a Rifle or Shotgun. You must be at least 21 years of age to purchase a Pistol or Revolver and can only purchase a handgun in the State in which you live. In other works, A Texas Licensed Dealer can only sell handguns to Texas residents only. Not Arkansas or any other State.
AMMUNITION AGE Rifle and Shotgun ammunition 18 years. Handgun ammo 21 years of age. Ammunition interchangeable between rifles and handguns (such as .22 caliber rimfire) may be sold to an individual at least 18 years of age, but less than 21, IF the Licensed Dealer is satisfied that the ammunition is being acquired for use in a rifle and Not a handgun.
ALCOHOLIC BEVERAGES Federal Law states that a person who is drinking Alcoholic beverages or has the smell of such on his/her breath CANNOT be sold a Firearm or Ammunition. DO NOT open that bottle or can until after you have made your gun or ammo purchases and gotten home.
CHILD SAFETY LOCK ACT OF 2005 The Child Safety Lock Act of 2005, which is Section 5 of the Protection of Lawful Commerce in Arms Act, requires dealers to provide a safety device to handgun purchasers starting April 24, 2006. This new section makes it generally unlawful for any Licensed importer, manufacturer, or dealer to sell, deliver, or transfer any handgun to any person, other than another licensee, unless the transferee (buyer) is provided with a secure gun storage or safety device for that handgun.
